1. Acknowledgement of Risk

I understand that swimming and associated activities carry inherent risks, including but not limited to drowning, slips, falls, collisions, injury, illness, and other harm. These risks may arise from my own actions, the actions or omissions of others, conditions of the facilities, or events beyond anyone’s control.
I confirm that I (or my child) participate voluntarily, accept these risks, and take full responsibility for my own safety (or my child’s safety) during participation, except where harm is caused by the proven negligence or breach of statutory duty of Bristol Swim Club, its staff, or contractors.

2. Responsibility and Liability

Nothing in this agreement limits or excludes Bristol Swim Club’s liability for death or personal injury caused by its negligence, or for fraud.
To the fullest extent permitted by law, I accept full responsibility for any death, personal injury, loss, or damage arising from participation that is not caused by the negligence or breach of statutory duty of Bristol Swim Club, its staff, or contractors.
This includes, without limitation:

• Injury, illness, or harm resulting from my own actions or inactions (or those of my child)

• Injury, illness, or harm caused by other participants or third parties

• Loss of or damage to property

• Indirect or consequential losses (including financial loss)

• Events or circumstances that could not reasonably have been foreseen or prevented

3. Medical Consent

In the event of a medical emergency, I authorise Bristol Swim Club staff to arrange medical treatment for me or my child, including the use of emergency services. I agree that Bristol Swim Club will not be liable for any treatment decisions made in good faith. I accept responsibility for any resulting costs.

4. Health Statement

I confirm that I or my child is in good health and fit to participate in swimming activities. I will notify Bristol Swim Club before participation of any relevant medical conditions, allergies, or limitations.

5. Photography and Video

I consent to Bristol Swim Club taking photographs and videos during lessons for promotional purposes, including use on its website, printed materials, and social media, in compliance with UK data protection laws. Images will be stored securely and no personal data will be shared without consent.

6. Credits, Cancellations, and Refund Policy

Lessons are booked using credits/tokens purchased in advance. Credits/tokens are valid for twelve (12) months from the date of purchase.

• Non-refundable: All credits/tokens are non-refundable, except where required by law.

• Transferable (once only): Unused credits/tokens may be transferred one time only to another Bristol Swim Club member at the request of the purchaser, provided they are still valid. Once transferred, they cannot be transferred again.

• Booking cancellations: If you cancel a booked lesson with at least twenty-four (24) hours’ notice, the credit/token for that lesson will be returned to your account. If less than twenty-four (24) hours’ notice is given, the credit/token will be deducted whether or not you attend.

• Expiry: Credits/tokens not used within their 12-month validity period will expire automatically and cannot be refunded, extended, or transferred again.

7. Governing Law and Jurisdiction

This agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

8. Severability

If any provision of this agreement is found to be invalid or unenforceable, the remainder shall remain in full force and effect.

9. Entire Agreement

This document constitutes the entire agreement between the parties in relation to participation in Bristol Swim Club activities and supersedes any prior written or oral agreements. No amendment shall be valid unless in writing and signed by both parties.

10. Declaration

I have read and understood this document, and I agree to the terms set out above. I confirm that I am over 18 years of age, or the parent/guardian of the participant if under 18, and that I give my consent for participation.
